VBWR Wins Appeal in Plane Crash Suit
In the Fourth District Court of Appeal in West Palm Beach, Tim Volpe, Bill Roelke and Caroline Prieto secured a reversal of the trial court’s order denying arbitration of a plane crash suit brought against their flight school client. The suit was brought by the widow of an Aspen, Colorado student pilot killed in a mid-air collision over the Everglades. A flight school agreement signed by the student pilot provided for arbitration of all claims against the flight school. The pilot’s widow nontheless filed a wrongful death suit in Broward County, contending the flight school agreement was unenforceable. The flight school then moved to compel arbitration, which the trial court denied. In reversing the trial court, the Fourth District held all of Plaintiff’s claims, including the enforceability of the flight school agreement, must be resolved via arbitration.
